Terms of Service

Note: This is a convenience translation. The legally binding version is the German original at legal/agb.html. In case of discrepancy, the German text prevails.

Governing the use of AleaMatrix as well as the conclusion and handling of a Premium subscription.

§ 1 Scope

These Terms of Service (hereinafter "Terms") apply to all contracts between Rudolf Kramer (hereinafter "Provider"; contact details in the Imprint) and the users (hereinafter "User") of the online service AleaMatrix, available at https://aleamatrix.com.

Deviating or supplementary terms of the User will not become part of the contract unless the Provider expressly agrees to their validity in writing.

§ 2 Description of services

AleaMatrix is an information and visualisation tool that displays all possible combinations of selected European lottery systems (e.g. Austria 6/45, Germany 6/49, EuroJackpot, EuroMillions) as a spatial map and colour-codes historical draw data on top of it.

The service is intended solely for entertainment, analysis and educational purposes. Historical frequencies do not allow any inference about future draw results; every lottery draw is stochastically independent. The Provider expressly makes no predictions and gives no guarantee of any winnings (see also Disclaimer).

§ 3 Free and paid services

AleaMatrix is offered at two levels:

The Provider is entitled to further develop the feature set at both levels, provided that the core benefit of the Premium tier is preserved.

§ 3a Free trial period

Upon registering a user account, the User receives a free trial period of 30 calendar days with full access to all Premium features.

§ 4 Conclusion of contract

The presentation of prices and services in the app does not constitute a binding offer, but rather a non-binding invitation to submit an offer. The User submits a binding offer by clicking "Subscribe monthly" or "Subscribe annually" during the checkout process and successfully authorising payment.

The contract is concluded when the payment service provider confirms successful receipt of payment. The User receives confirmation by email at the address stored in the account.

§ 5 Prices and payment processing

The following prices apply to the Premium tier:

Payment is processed exclusively via the external payment service provider Stripe Payments Europe, Ltd. (The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland). The Provider receives from the payment service provider only confirmations of successful payment and the metadata necessary to manage the subscription; payment data (card numbers, bank details) is never stored by the Provider at any time. Stripe's own privacy provisions apply in addition.

§ 6 Term, renewal and cancellation

The subscription begins upon successful receipt of payment and runs for one month or one year, depending on the selected tariff. It automatically renews for the same period unless it is cancelled no later than the last day of the current period.

The User cancels the subscription themselves in the customer area (in the app: "Account & subscription" → "Manage subscription"), which leads them to the Stripe customer portal. No additional cancellation fees apply.

After an effective cancellation, the Premium features remain available until the end of the already paid period; the account is then automatically downgraded to the Free tier. Payments already made are not refunded on a pro-rata basis – subject to the statutory right of withdrawal (see Withdrawal).

The Provider reserves the right to terminate for good cause without notice, in particular in the event of serious breaches of § 8 (User obligations) or repeatedly failed payment attempts. In such cases, amounts already paid are refunded on a pro-rata basis, provided that the User is not responsible for the ground of termination.

§ 7 Price changes

The Provider may adjust prices for future billing periods. Price changes will be communicated to the User with a lead time of at least 30 days by email to the address stored in the account. If the User does not object to the price change before it takes effect, the change is deemed accepted. In the event of objection, the subscription ends at the end of the current period.

§ 8 User obligations

AleaMatrix neither provides gaming offerings nor brokers gaming contracts. Anyone who takes part in lottery games themselves does so with the respective regulated providers, at their own responsibility. Gambling can be addictive. The Provider expressly refers to low-threshold help services in your country – e.g. spielerhilfe.at (Austria), check-dein-spiel.de (Germany), sos-spielsucht.ch (Switzerland). § 10 Liability

The Provider's liability is governed by statutory provisions. For additional notes on liability for content, data loss and external links see Disclaimer. Liability for financial losses in connection with the User's actual lottery-play decisions is expressly excluded.

§ 11 Data protection

The processing of personal data takes place in accordance with the Privacy Policy. Invoices and payment receipts are created by the payment service provider and stored in accordance with statutory retention obligations under tax law.

§ 12 Changes to the Terms

The Provider reserves the right to adapt these Terms where required by changes in law, case-law or material changes to the scope of services. Material changes will be communicated to the User with a lead time of at least 30 days by email. If the User does not object within this period, the amended Terms are deemed accepted. In the event of objection, the subscription ends at the end of the current period.

§ 13 Applicable law and place of jurisdiction

Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Vis-à-vis consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is – to the extent legally permissible – 4091 Vichtenstein. Consumers may in addition use the EU online dispute resolution platform.

§ 14 Severability

If individual provisions of these Terms are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provision shall take the place of the invalid provision.
